These Terms of Service ("Terms") govern the access to and use of the website located at www.klassicbilling.com (the "Site") and the medical billing services provided by Klassic Billing ("Company," "we," "us," or "our"). By accessing our Site or utilizing our services, you ("Client," "User," or "you"), representing a healthcare provider or practice, agree to be bound by these Terms.


1. Services Provided

Klassic Billing provides comprehensive mental health medical billing services to healthcare providers and facilities. Our services include, but are not limited to:

  • Claims submission and tracking;
  • Payment posting and reconciliation;
  • Denial management and appeals;
  • Revenue cycle management (RCM);
  • Consultation on billing efficiency and revenue maximization.

The specific scope of services for each Client shall be defined in a separate Service Agreement or Statement of Work.


2. Client Responsibilities and Representations

As a condition of using our services, the Client agrees to:

  • Accuracy of Information: Provide complete, accurate, and timely data required for billing, including patient demographics, insurance information, and encounter codes. Klassic Billing is not responsible for claim denials or delays resulting from inaccurate information provided by the Client.
  • Compliance with Laws: Maintain compliance with all federal and state laws, including the Health Insurance Portability and Accountability Act (HIPAA), the Affordable Care Act (ACA), and all applicable medical coding standards (e.g., ICD-10, CPT).
  • Authorization: Represent and warrant that they have obtained all necessary consents and authorizations from patients to share protected health information (PHI) with Klassic Billing for the purpose of billing and payment operations.


3. Professional Standards

Klassic Billing leverages over a decade of industry experience (since 2010) to provide customized solutions. We commit to maintaining a highly trained team that stays current with healthcare industry trends and regulations. However, the Client acknowledges that medical billing is subject to the policies of third-party payers and government agencies, and Klassic Billing does not guarantee specific reimbursement amounts.


4. Fees and Payment Terms

  • Service Fees: Our service fee is 6.5% of the Client’s monthly net revenue, as further defined in the Client’s Service Agreement.
  • Invoicing; Payment Due Date: We invoice on the last business day of each month. Payment is due within three (3) business days of the invoice date.
  • Disputes: The Client must raise any invoice disputes in writing within two (2) business days of the invoice date. If the Client does not timely dispute an invoice, the invoice will be deemed accepted.
  • Late Payments: Late fees will be assessed in the amount of $35 or ten percent (10%) of the past-due amount, whichever is higher. Failure to pay fees when due may also result in suspension of services.
  • Payment Method Fees: A 1% fee applies to payments made via Zelle. A $25 fee applies to returned checks (in addition to any applicable late fees).


5. HIPAA Compliance and Data Security

Klassic Billing is committed to the highest standards of data security and patient privacy.

  • Business Associate Agreement (BAA): Prior to the exchange of any PHI, Klassic Billing and the Client shall enter into a BAA to ensure compliance with HIPAA regulations.
  • HIPAA Privacy and Security: We strictly follow the HIPAA Privacy Rule and Security Rule.
  • Minimum Necessary: We access, use, and disclose only the minimum necessary PHI to perform the services.
  • Safeguards and Training: We implement strong administrative, physical, and technical safeguards (including physical security and cybersecurity measures) to protect the confidentiality, integrity, and availability of PHI and electronic PHI, and we maintain ongoing workforce training to support HIPAA compliance.


6. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Klassic Billing or its content suppliers and is protected by intellectual property laws. Clients are granted a limited, non-exclusive license to use our proprietary reporting tools and templates solely for their internal business operations during the term of service.


7. Limitation of Liability

To the maximum extent permitted by law, Klassic Billing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. The Client is responsible for providing complete, accurate, and timely information required to perform the services, and Klassic Billing is not liable for any issues, denials, delays, underpayments, or other outcomes caused by inaccurate, incomplete, or untimely data or instructions provided by the Client. Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total fees paid by the Client to Klassic Billing in the six (6) months preceding the event giving rise to the claim.

8. Indemnification

The Client agrees to indemnify, defend, and hold harmless Klassic Billing and its officers, directors, and employees from and against any claims, liabilities, damages, or expenses (including reasonable legal fees) arising out of the Client’s breach of these Terms, negligence, or the submission of fraudulent billing data.


9. Term and Termination

  • Term: These Terms remain in effect as long as the Client utilizes our services or accesses the Site.
  • Termination: Either party may terminate the service relationship in accordance with the notice period defined in the Client’s Service Agreement.
  • Effect of Termination: Upon termination, the Client shall pay for all services rendered up to the date of termination. Klassic Billing will cooperate in the transfer of records in a secure manner, subject to applicable fees.


10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State in which Klassic Billing is headquartered, without regard to its conflict of law principles. Any legal action arising under these Terms shall be brought exclusively in the courts located in that jurisdiction.


11. Amendments

Klassic Billing reserves the right to modify these Terms at any time. We will notify Clients of significant changes by posting the updated Terms on our Site. Continued use of our services following such changes constitutes acceptance of the revised Terms.
